Labour Court bars Manamela from restarting NSF CEO recruitment

SABC News ·

The Labour Court has interdicted Higher Education Minister Buti Manamela from restarting the recruitment process for the National Skills Fund (NSF) CEO post.

The court found that the Minister’s directive appeared to exceed his legal powers, with the law assigning the appointment authority to the department’s Director-General.

Dr.

Khathutshelo Sirovha was unanimously recommended for the position following a recruitment process involving 93 applicants.

The interim interdict will remain in place pending the final determination of a separate application challenging the legality of the Minister’s directive.

The South African Youth Economic Council (SAYEC) has welcomed the judgment by the Labour Court saying the ruling reinforces the rule of law and ensures that public institutions operate within their legally prescribed powers.

The organisation is calling on Manamela to take the necessary lawful steps to finalise the appointment of Dr.

Khathutshelo Sirovha, who was unanimously recommended for the position.

SAYEC has warned that further delays could result in costly litigation, while prolonging uncertainty at the fund and affecting its ability to support skills development.
